1.はじめに

1. ショッピー・ジャパン株式会社とその関連会社および子会社（個別または集合的に、「Shopee」、「当社」または「当社の」）が運営するShopeeプラットフォームおよびすべての販売サイトプラットフォームおよびその他のShopee関連サービスプラットフォーム（「本プラットフォーム」）へようこそ。Shopeeは、適用されるプライバシー法および規制（以下「プライバシー法」）に基づく責任を真剣に受け止め、Shopeeのウェブサイト（以下「本サイト」）のすべてのユーザーのプライバシー権および懸念を尊重することを約束します（当社は、本サイトおよび本サイトに記載されている当社が提供するサービスをまとめて「サービス」と呼んでいます）。当社は、お客様からお預かりした個人情報の重要性を認識し、お客様の個人情報を適切に管理、保護、処理することが当社の責任であると考えています。このプライバシーポリシー（「プライバシーポリシー」または「ポリシー」）は、現在または将来において、お客様が当社に提供した、あるいは当社が保有するお客様の個人データの収集、使用、開示および/または処理方法をお客様が理解するのを支援し、また、お客様の個人データを当社に提供する前に、お客様が十分な情報に基づいて決断するのを支援するために作成されたものです。
2. 「個人データ」とは、個人に関するデータで、そのデータから個人を特定できるもの、またはそのデータと組織がアクセスできる可能性のあるその他の情報から個人を特定できるものをいいます。個人データの一般的な例としては、氏名、身分証明書番号、連絡先などがあります。
3. サービスの使用、当社へのアカウント登録、当社ウェブサイトへの訪問およびアクセスにより、お客様は、本プライバシーポリシーに概説される慣行、要件、および/または方針を受け入れることを認め、同意し、また、当社が上記第1.2条に記載されるお客様の個人データを収集、使用、開示および/または処理することにここに同意されるものとします。
   このプライバシーポリシーに記載されているお客様の個人データの処理に同意されない場合は、当社のサービスの使用または当社ウェブサイトへのアクセスをご遠慮ください。当社がプライバシーポリシーを変更した場合、当社はその変更内容または変更後のプライバシーポリシーを当社ウェブサイトに掲載します。当社は、いつでもこのプライバシーポリシーを修正する権利を留保します。
4. 本ポリシーは、当社によるお客様の個人データの収集、保存、使用、開示および/または処理に関連して適用される他の通知、契約条項、同意条項とともに適用され、当社が明示的に別段の定めをしない限り、これらの通知または条項を無効にすることを意図するものではありません。

なお、本ポリシーは、他の第三者がお客様に提供するサービスには適用されず、当該第三者がお客様に説明するプライバシーポリシーが適用されるものとします。

このプライバシーポリシーの項目は、以下のことをご理解いただくためのものです。(1) Shopeeが個人情報を収集する時期（第2項）、(2) Shopeeが収集する個人情報（第3～6項）、(3) Shopeeによる個人情報の利用目的、Shopeeによるお客様情報の利用および保護方法（第7～12項）。

2. ショッピーはいつ個人情報を収集するのですか？

1. 当社は、お客様に関する個人情報を収集する可能性があります。
   1. お客様が当社のサービスまたは本サイトに登録および/または使用するとき、または当社にアカウントを開設するとき。
   2. お客様が当社の製品およびサービスに関連する申込書等の書式を、オンラインまたは物理的な書式により提出する場合（ただし、これらに限定されません）。
   3. お客様が当社との交流に関して契約を締結したり、その他の文書や情報を提供したり、当社の製品やサービスを利用したりする場合。
   4. 電話（録音される場合があります）、手紙、ファックス、対面式会議、ソーシャルメディアプラットフォーム、電子メールなどを通じて、お客様が当社とやり取りするとき（当社の顧客サービス担当者とやり取りするときを含みます）。
   5. 交流グループフォーラムで、他のユーザーからの質問に回答する場合。
   6. お客様が当社の電子サービスを利用する際、または当社のアプリケーションを通じて当社と対話する際、あるいは当社のウェブサイト上のサービスを利用する際。これには、お客様が当社のアプリケーションまたはウェブサイトと対話する際に当社が導入する可能性のあるクッキーが含まれますが、これに限定されるものではありません。
   7. お客様が当社のアプリケーションまたはプラットフォームと情報を共有する許可をお客様のデバイス上で付与する場合。
   8. プロバイダの方針に従って、お客様がShopeeアカウントをソーシャルメディアやその他の外部アカウントとリンクさせたり、その他のソーシャルメディア機能を使用したりする場合。
   9. お客様が当社のサービスを通じて取引を行う場合。
   10. お客様からご意見、苦情があった場合。
   11. お客様がコンテストや様々なマーケティング活動のために登録される場合、またはお客様が何らかの理由で当社に個人情報を提供された場合。
   上記は、お客様に関する個人データが収集される場合の一般的な例を示したものであり、すべてを網羅するものではありません。

3. ショッピーはどのような個人情報を収集するのですか？

1. Shopeeが収集する個人データには、以下のものが含まれますが、これらに限定されるものではありません。
   1. 基本情報（氏名、年齢、生年月日、性別、住所、請求書送付先、個人電話番号、電子メールアドレス等）。
   2. 個人識別情報および政府識別書類（身分証明書、役員証、パスポート、運転免許証などを含む）。
   3. お客様が当社と共有する写真または音声もしくは映像の記録（顔の特徴、音声などの記録を含みます。）
   4. ネットワーク識別情報（前述に関連するシステムアカウント、IPアドレス、電子メールアドレス、パスワードを含む。）
   5. 個人資産情報（取引、銀行口座、ポイント、クーポン、プラットフォーム口座残高など）。
   6. 個人インターネット記録（コンピュータのIPアドレス、オペレーティングシステム、ウェブサイト閲覧記録、ソフトウェア使用記録、クリック記録等を含む）、個人共用機器情報（ハードウェアモデル、機器のMACアドレス、オペレーティングシステムの種類、ソフトウェアリスト固有の機器識別コード（IMEI/アンドロイドID/IDFA/OPENUDID/GUID等）、個人共用機器の基本状況を表すSIMカードIMSI情報等）、個人位置情報（移動情報、精密測位情報、宿泊情報、経緯度等）を含む）、第三者サービスプロバイダのアカウント情報。
   7. ユーザーが当社サービスまたはサイトの利用を申し込んだとき、およびユーザーが当社サービスまたはサイトを利用したとき、およびユーザーが当社サービスまたはサイトをどのように利用したかに関連するその他の情報。
   8. ユーザーが関与したコンテンツに関する集計データ。
2. お客様は、不正確または誤解を招くような情報を当社に提出しないことに同意し、また、かかる情報の不正確性または変更について当社に通知することに同意するものとします。当社は、独自の裁量で、お客様から提供された情報を確認するためにさらなる書類を要求する権利を留保します。
3. 上記の情報/個人データの収集を希望されない場合は、当社のデータ保護担当者に書面で通知することにより、いつでもオプトアウトすることができます。オプトアウトに関する詳細は、以下の "同意の撤回、削除、当社へ提供した情報へのアクセス要求または訂正の方法 "に記載されています。.ただし、当社がお客様の個人データを収集、使用、処理することに対するお客様の同意をオプトアウトまたは撤回すると、お客様の本サービスおよびプラットフォームの使用に影響を与える可能性があることに留意してください。例えば、位置情報の収集をオプトアウトすると、その位置情報機能は無効になります。

4. その他データ収集

1. ほとんどのウェブサイトおよびモバイルアプリケーションと同様に、お客様が当社のサービスを使用する際に、お客様のデバイスは、ウェブサーバーによって記録されるお客様に関するデータを含む可能性のある情報を送信します。これには通常、お客様のデバイスのインターネットプロトコル（IP）アドレス、コンピュータ/モバイルデバイスのオペレーティングシステムおよびブラウザの種類、モバイルデバイスの種類、モバイルデバイスの特性、お客様のモバイルデバイスの固有デバイス識別子（UDID）またはモバイル機器識別子（MEID）、参照ウェブサイトのアドレス（ある場合）、お客様が当社のウェブサイトおよびモバイルアプリケーションで訪れたページと訪れた時間、そして時にはお客様の最後の訪問をサイトが記憶するための「クッキー」（お客様のブラウザ設定により無効にできます）、が無制限で含まれています。お客様がログインされている場合、この情報はお客様の個人アカウントに関連付けられます。また、これらの情報は、訪問者が当社のゲームおよびサイトをどのように利用しているかを理解するための匿名統計にも含まれます。
2. 当社のモバイル・アプリケーションは、GPS、Wi-Fi等の技術を使用して、お客様のモバイル・デバイスの位置に関する正確な情報を収集する場合があります。当社は、この情報を、お客様が要求するロケーションベースのサービス、またはお客様のロケーションに基づく関連コンテンツの配信、あるいは当社のモバイルアプリケーションのサービスの一環としてお客様が他のユーザーとロケーションを共有できるようにすることを含むがこれに限定されない、一つまたは複数の目的のために収集、使用、開示および/または処理するものとします。ほとんどのモバイルデバイスでは、お客様は、デバイスの設定を通じて、当社がお客様の位置情報を取得することの許可を取り消すことができます。お客様のモバイルデバイスの位置情報サービスを無効にする方法についてご質問がある場合は、お客様のモバイルデバイスのサービスプロバイダまたはデバイスの製造元にお問い合わせください。
3. お客様が当社のウェブサイトまたはモバイルアプリケーションのページを閲覧するときと同様に、お客様が当社のプラットフォーム上または本サービスを通じてコンテンツや広告を視聴し、その他のソフトウェアにアクセスすると、ほとんど同じ情報が当社に送信されます（IPアドレス、オペレーティングシステムなどを含みますが、これに限定されません）。ただし、ページビューの代わりに、お客様のデバイスから、コンテンツ、広告の視聴および/または本サービスおよびプラットフォームによってインストールされたソフトウェアと時間についての情報が当社に送信されます。

5. クッキー

1. 当社または当社の認定サービスプロバイダは、随時、「クッキー」またはその他の機能を使用して、当社または第三者がお客様の当社サービスまたはプラットフォームの使用に関連して情報を収集または共有することを可能にすることがあります。これらの機能は、当社がプラットフォームおよび当社が提供するサービスを改善し、または当社が新しいサービスおよび機能を提供するのに役立ちます。「クッキー」とは、お客様のコンピュータまたはモバイルデバイスに保存される識別子であり、コンピュータまたはデバイスに関するデータ、サービスまたはプラットフォームがいつどのように使用または訪問されたか、何人によるものか、および当社プラットフォーム内の他の活動を記録します。当社は、クッキーの情報を個人データにリンクすることがあります。クッキーは、お客様が購入のために選択したアイテムおよびお客様が閲覧したウェブページに関する情報にもリンクします。この情報は、お客様のショッピングカートを追跡し、お客様の興味に応じたコンテンツを配信し、データ分析を行い、本サービスの利用状況を監視するために使用されます。
2. お客様は、お客様のブラウザまたはデバイスの適切な設定を選択することにより、クッキーの使用を拒否することができます。ただし、その場合、当社のプラットフォームまたは本サービスのすべての機能をご利用いただけない場合がありますので、ご了承ください。

6. お客様の義務

1. 本サービスの利用を通じて他のユーザーの個人データを保有するユーザー（以下「受領側」といいます）は、ここに、(i) かかるデータに関して適用されるすべての個人データ保護法を遵守することに同意するものとします。(ii) 受領当事者が個人データを収集したユーザー（以下「開示当事者」）が、受領当事者のデータベースから収集した自分のデータを削除できるようにすること、および (iii) 上記 (ii) および (iii) の各場合に、適用法に従って、また適用法で要求される場合には、開示当事者が受領当事者によって収集された情報を確認することができるようにすることです。
2. 本規約にかかわらず、他のユーザーの個人情報を所有するユーザーは、適用されるすべてのプライバシー法を遵守するものとし、Shopeeから受け取った購入者の個人情報に関しては、(i)購入者の問い合わせに対応し、購入者およびShopeeの書面による事前承諾なしに取引を実行、処理、取引または完了するために合理的に必要な場合以外、かかる購入者の個人情報を使用することは許可されず、 (ii) Shopeeプラットフォーム外でかかる情報を使用して購入者に連絡することを差し控える必要があるものとします。(iii) 買い手とShopeeの事前の書面による同意なしに、当該買い手の個人データを無許可の第三者に開示することは許されません。(iv) 保有する各Shopeeユーザーの個人データを保護するために十分なセキュリティ対策を採用し、取引完了後は合理的に可能な限り速やかに当該データを削除します。(v) 当該ユーザーのデータ侵害またはその他の損失の可能性が生じた場合、Shopeeの個人データ保護担当者に dpo.jp@shopee.com で通知するものとします。
3. 本規約は、Shopee利用規約の追加条項・附則、Shopeeが発行する各種SIPルール・運用ガイドライン、およびお客様が本サービスの利用に関連して締結するその他のプライバシーポリシー・規約等に定める条件を追加し、補完するものとします。

7. お客様から提供された情報をどのように使用するか？

1. 当社は、以下の目的のために、お客様の個人情報を収集、使用、開示および/または処理することがあります。
   1. お客様の当社との申込・取引、または本サービスを通じた第三者との取引・通信を検討・処理するため。
   2. お客様の当社サービスおよびサイト（お客様の好みを含むがこれに限定されない）の使用および/またはアクセス、ならびに当社とお客様の関係およびユーザーアカウントの管理、運営、提供および/または運用のため。
   3. 取引への対応、処理、対処、完了、および/または特定の製品やサービスに対するお客様の要望を満たすため、およびサービスの問題や異常なアカウントアクションをお客様に通知するため。
   4. 当社のサービス利用規約または適用されるエンドユーザーライセンス契約を執行するため。
   5. 個人の安全および他人の権利、財産、安全を保護するため。
   6. 本人確認および/または検証のため。
   7. 当社サービスの円滑な運営を確保するために随時必要となるソフトウェアの更新および/またはその他のアップデートおよびサポートを維持、管理すること。
   8. 顧客サービス、お客様の指示の実行、お客様から（またはお客様からと称する）またはお客様の代理でなされたお問い合わせへの対応または促進のため。
   9. 当社とお客様との関係または当社サービスの使用を管理および/または運用する目的で、音声通話、テキストメッセージおよび/またはファックスメッセージ、電子メールおよび/または郵便またはその他の方法でお客様に連絡または通信すること（当社サービスに関連するお客様に対する管理情報の伝達に限定されません）。お客様は、当社によるこのようなコミュニケーションが、お客様への通信、文書または通知の郵送によるものであり、封筒/メールパッケージの外装と同様に、その配達をもたらすためにお客様に関する特定の個人データの開示を伴う可能性があることを認め、同意するものとします。
   10. 他のユーザーがお客様にプライベートメッセージを送信したとき、または本サイトにお客様宛のコメントを投稿したときに、お客様に通知するため。
   11. 調査、分析、開発活動（データ分析、調査、製品・サービス開発、プロファイリングを含むがこれらに限定されない）、お客様の当社サービスの利用状況の分析、当社サービスまたは製品の改善、および/またはお客様のカスタマーエクスペリエンスの向上のため。
   12. 広告およびその他の監査や調査を行い、特にターゲットオーディエンスのサイズと構成を検証し、Shopeeのサービスに関する経験を理解するため。
   13. 当社は、お客様に対し、マーケティングを目的として、Shopee（および／またはその関連会社）が販売、マーケティング、宣伝する製品および／またはサービス（Shopeeが協力または提携する第三者の製品および／またはサービスを含むが、これに限らない）に関するマーケティングおよび宣伝情報および資料を、現在存在するか将来作成されるかにかかわらず、様々な通信手段で送信することができるものとします。お客様は、電子マーケティング資料内の配信停止機能を使用することで、いつでもマーケティング情報の受信を停止することができます。当社は、お客様の連絡先情報を、当社および当社の関連会社からニュースレターを送付するために使用することがあります。
   14. 法的手続きに応じるため、または適用法、政府または関連法域の規制要件に従うため、あるいは当社がそのような開示が必要であると誠実に考える場合。これには、Shopeeまたはその関連法人もしくは関連会社を拘束する法律の要件に基づき開示を行う要件を満たすこと（該当する場合、お客様の氏名、連絡先および会社情報の表示を含む）が含まれますが、これに限定されるものではありません。
   15. 内部報告や法定報告、記録保持のために必要な統計や調査を作成すること。
   16. 法律または規制上の義務、あるいは法律で要求される、あるいは当社が導入しているリスク管理手順に従って、デューデリジェンスまたはその他のスクリーニング活動（身元調査を含むがこれに限定されない）を実施するため。
   17. 当社のサービスまたはShopeeのビジネスを監査するため。
   18. お客様の当社サービスの利用またはお客様と当社との関係に起因するその他の事項に関する不正行為、違法行為、不作為または違法行為を防止または調査するため、および前述の疑いがあるか否かを問わないこと。
   19. お客様の管轄区域の内外を問わず、お客様の個人データを保存、ホスト、バックアップ（災害復旧のためか否かを問わない）すること。
   20. 事業用資産取引または事業用資産取引の可能性を処理および/または促進すること。当該取引には、Shopeeが参加者として関与するか、Shopeeの関連企業または関連会社のみが参加者として関与するか、Shopeeおよび/またはShopeeの関連企業または関連会社が参加者として関与し、当該取引の他の第三者組織が参加者となる場合があるものとします。事業用資産取引」とは、組織または組織の一部、あるいは組織の事業または資産の購入、売却、リース、合併、合併、その他の取得、処分、融資、および/またはを指します。
   21. お客様の同意を得る際に当社がお客様に通知したその他の目的。(以下、総称して「目的」といいます。）
2. お客様は、法律、裁判所の命令、またはShopeeを管轄する政府機関や規制当局から要求された場合、またはそのようなアクセスの保存や開示が合理的に必要であると誠実に判断した場合、Shopeeがお客様のアカウント情報やコンテンツをアクセス、保存、開示できることを認め、同意し、同意するものとします。(a)法的手続きの遵守 (b)Shopeeを管轄する政府または規制当局からの要請の遵守 (c)Shopee利用規約または本プライバシーポリシーの施行 (d)Shopeeに対して申し立てられた脅威または実際の請求、またはコンテンツが第三者の権利を侵害しているというその他の請求への対応 (e) カスタマーサービスに対するお客様の要望への対応 (f) Shopee、そのユーザー、および公衆の権利、財産または個人の安全を守ること。
3. 当社がお客様の個人データを収集、使用、開示または処理する目的は、その時々の状況によって異なるため、そのような目的が上記に記載されていない場合もあります。ただし、お客様の同意なく該当データを処理することが個人情報保護法により認められている場合を除き、当社は、お客様の同意を得る際に、かかる他の目的についてお知らせします。

8. ショッピーはどのように顧客情報を保持し、保護しているのですか？

1. 当社は、当社のシステム上のお客様の個人情報の安全性を確保するために、物理的、技術的、管理的な措置を含むがこれに限定されない様々なセキュリティ対策を実施し、損失、誤用、不正アクセス、開示、修正のリスクを最小限に抑えています。様々な悪意のある手法や科学技術の絶え間ない進歩により、当社が上記のような対策を講じたとしても、お客様の個人情報が開示、損傷、紛失する可能性があることをご理解いただき、Shopeeはこれに対するいかなる約束や保証もいたしません。
2. 当社は、個人情報保護法および／またはその他の適用法に従って、個人データを保持します。すなわち、当社は、(i) 当該個人データの保持によって当該個人データが収集された目的が果たされなくなった場合、(ii) 法的または事業目的のために保持が不要になった場合、および (iii) その他の正当な利益によって当該個人データのさらなる保持が保証されないと合理的に判断した場合には、お客様の個人データを破棄または匿名化します。お客様が当社のサービスの利用を中止した場合、またはサイトおよび/またはサービスの利用許可が終了した場合、当社は本プライバシーポリシーおよびプライバシー法に基づく当社の義務に従って、お客様の個人データの処理を継続することができます。

9. shopeeは訪問者から収集した情報を第三者に開示するのか？

1. 当社は、当社の事業を行うにあたり、上記の目的のために、当社の第三者であるサービス・プロバイダー、代理店、関連会社、その他の第三者（日本国内外にかかわらず）にお客様の個人情報を開示する必要がある場合またはその可能性があります。当該第三者サービス・プロバイダー、代理店、関連会社、その他の第三者は、当社に代わって、またはその他の方法で、上記の目的のためにお客様の個人データを処理することになります。このような第三者には、以下のものが含まれますが、これらに限定されるものではありません。
   1. 当社の子会社、関連会社および関連会社
   2. 当社のウェブサイト利用者が、上記の目的の一つまたは複数を達成するため。
   3. 請負業者、代理店、サービスプロバイダ、および当社が当社のビジネスをサポートするために利用するその他の第三者（以下、「認定パートナー」）。これには、メーリングハウス、通信会社、情報技術会社、データセンターなど、当社に管理サービスやその他のサービスを提供する者が含まれますが、これらに限定されません。当社は、このプライバシーポリシーに記載されている法的、正当、必要、特定、明確な目的のために限定的にお客様の情報を共有するものとします。権限を与えられたパートナーは、その職務を遂行するために必要な情報にのみアクセスすることができ、この情報を他の目的に使用してはならないものとします。
   4. 当社のユーザーに関して当社が保有する個人情報が譲渡される、当社の資産の一部または全部の合併、分割、再編、整理、解散またはその他の売却または譲渡（継続企業としてか破産、清算または同様の手続きの一部としてかを問いません）の場合の買い手またはその他の後継者、または当社またはその関連会社または関連企業が関与する事業資産取引の取引相手方、および
   5. 当社による開示が1つまたは複数の目的のために行われ、当該第三者が順次1つまたは複数の目的のためにお客様の個人情報を収集および処理することになる第3者。
2. このため、特に、当社が、当社のユーザーに関する統計的および人口統計的な情報ならびにサービスの利用に関する情報を、広告およびプログラミングの供給者と共有することが必要となる場合があります。
3. 誤解を避けるため、個人情報保護法またはその他の適用法により、組織（Shopeeなど）がお客様の同意なしにお客様の個人データを収集、使用、開示することが許可されている場合、法律で認められたその許可が引き続き適用されるものとします。
4. 第三者が当サイトに送信された、または当サイトに含まれる個人データを不法に傍受またはアクセスする可能性があり、技術が誤動作したり、予想通りに動作しない可能性があり、または誰かが当社の過失によらず情報にアクセス、悪用または誤用する可能性があります。当社は、個人情報保護法の規定に従い、お客様の個人情報を保護するために合理的なセキュリティ対策を実施しますが、当社の過失によらない悪意のある高度なハッキングによる不正な情報開示など、絶対的な安全性を保証するものではありません。

10. 第三者が収集した情報

1. 当社サイトでは、Google, Inc.（以下、「Google」）が提供するウェブ解析サービス「Google Analytics」を利用しています。Google Analyticsは、Cookie（お客様の端末に置かれるファイル）を使用して、当サイトがユーザーの本サービスの利用状況を分析するのに役立ちます。クッキーによって生成された、お客様の本サービスまたは端末の使用に関する情報（お客様のIPアドレスを含む）は、Googleによって米国内のサーバーに送信され、保存されます。Googleは、お客様の本サービスの利用を評価し、ウェブサイト運営者向けにウェブサイトの活動に関するレポートを作成し、ウェブサイトの活動やインターネット利用に関するその他のサービスを提供する目的で、この情報を使用します。また、Googleは、法律で義務付けられている場合、または第三者がGoogleに代わって情報を処理する場合、この情報を第三者に転送することがあります。Googleは、お客様のIPアドレスを、Googleが保有する他のデータと関連付けることはありません。
2. 当社および第三者は、随時、本サービス上で、または本サービスを通じて、お客様が使用できるソフトウェアアプリケーションをダウンロードできるようにすることがあります。これらのアプリケーションは、お客様が以前にインストールした、または第三者のソフトウェアアプリケーションやウェブサイトによってお客様のためにインストールされたクッキーなどのお客様を特定できる情報（お客様の名前、ユーザーID、お客様のデバイスのIPアドレス、その他の情報など）に個別にアクセスし、第三者に閲覧させることができる場合があります。さらに、これらのアプリケーションは、お客様に直接第三者への追加情報の提供をお願いする場合があります。これらのアプリケーションを通じて提供される第三者の製品またはサービスは、Shopeeが所有または管理するものではありません。お客様は、当該第三者がウェブサイト等で公表している条件やその他の方針を読むことが推奨されます。

11. セキュリティとサードパーティサイトに関する免責事項

1. The personal data that Shopee may collect includes but is not limited to:
   1. Basic information (including name, age, date of birth, gender, residential address, billing address, personal telephone number, e-mail address, etc.);
   2. Personal identification information and government identification documents (including ID card, officer ID, passport, driving license, etc.);
   3. Photographs or audio or video recordings that you share with us (including records of facial features, voice, etc.);
   4. Network identification information (including system account, IP address, email address and password related to the foregoing);
   5. Personal property information (transactions, bank accounts, points, coupons, platform account balances, etc.);
   6. Personal Internet records (including computer IP address, operating system, website browsing records, software usage records, click records, etc.); Personal common device information (including hardware model, device MAC address, operating system type, software list unique device identification code (such as IMEI/android ID/IDFA/OPENUDID/GUID, SIM card IMSI information, etc. describing the basic situation of personal commonly used equipment)); Personal location information (including travel information, precise positioning information, accommodation information, latitude and longitude, etc.);

   8. Any other information about the user when the user signs up to use our Services or Sites, and when the user uses the Services or Sites, as well as information related to how the user uses our Services or Sites; and

Notwithstanding anything set forth herein, Users in possession of another User’s personal data shall comply with all applicable Privacy Laws and, in respect of any buyer’s personal data received from Shopee, (i) are not permitted to use such buyer’s personal data except as reasonably necessary to respond to buyers’ enquiries and to carry out respond to, process, deal with or complete a transaction without the buyers’ and Shopee’s prior written consent; (ii) should refrain from contacting buyers using such information outside of the Shopee platform; (iii) are not permitted to disclose such buyer’s personal data to any unauthorized third parties without the buyer’s and Shopee’s prior written consent; (iv) shall employ sufficient security measures to protect each Shopee user’s personal data in their possession and to delete such data as soon as reasonably possible upon completion of the transaction; and (v) to inform Shopee’s Personal Data Protection Officer at dpo.jp@shopee.com in the event of any potential data breach or other loss of such user’s data.
3. These obligations are in addition to and shall supplement the terms as set out in Shopee’s Terms of Service the additional terms / the Supplementary Agreements and various SIP rules and operation guidelines published by Shopee and other privacy policy or policies you may enter into in connection with your use of the Services.

   14. to respond to legal processes or to comply with or as required by any applicable law, governmental or regulatory requirements of any relevant jurisdiction or where we have a good faith belief that such disclosure is necessary, including, without limitation, meeting the requirements to make disclosure under the requirements of any law binding on Shopee or on its related corporations or affiliates (including, where applicable, the display of your name, contact details and company details);

You acknowledge, consent and agree that Shopee may access, preserve and disclose your Account information and Content if required to do so by law or pursuant to an order of a court or by any governmental or regulatory authority having jurisdiction over Shopee or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) comply with a request from any governmental or regulatory authority having jurisdiction over Shopee; (c) enforce the Shopee Terms of Service or this Privacy Policy; (d) respond to any threatened or actual claims asserted against Shopee or other claim that any Content violates the rights of third parties; (e) respond to your requests for customer service; or (f) protect the rights, property or personal safety of Shopee, its users and/or the public.

2. We will retain personal data in accordance with the Privacy Laws and/or other applicable laws. That is, we will destroy or anonymize your personal data when we have reasonably determined that (i) the purpose for which that personal data was collected is no longer being served by the retention of such personal data; (ii) retention is no longer necessary for any legal or business purposes; and (iii) no other legitimate interest warrant further retention of such personal data. If you cease using our Services, or your permission to use the Site and/or the Services is terminated, we may continue processing your personal data in accordance with this Privacy Policy and our obligations under the Privacy Laws.

9. DOES SHOPEE DISCLOSE THE INFORMATION IT COLLECTS FROM ITS VISITORS TO THIRD PARTIES?

1.
